A Comprehensive Guide to Market Access & Compliance

To regulate the sale and safe use of vaping products, New Zealand’s Ministry of Health has issued strict standards for packaging, flavor descriptions, point-of-sale displays, and product declarations. Below is a concise summary from the iPure compliance team:


I. Mandatory Packaging Requirements
Bilingual health warning is required on both front and back of all nicotine-containing products:

  • English: “This product contains nicotine, which is a highly addictive substance.”

  • Māori: “He nikotini kei roto i tēnei mea, he matū tino whakawara.”

Labeling requirements:

  • Helvetica font, black text on white background

  • Centered, occupying maximum available space

  • Aligned with the brand or flavor name

Other mandatory label information:

  • Product name and ingredients (CAS or IUPAC format)

  • Ingredient quantity (mg) and nicotine concentration (mg/ml)

  • VG/PG ratio, container volume

  • Batch number, expiry date (M/YY or MM/YYYY)

  • Manufacturer's name, address, phone, and email

  • Safety instructions (including poisoning response guidance)

  • “Contains alcohol” if alcohol content >3%

  • “Non-nicotine” or “Zero nicotine” for nicotine-free products


II. Flavor Naming Restrictions

Only 1–2 official flavor names allowed per product. Examples include:

Fruits: Strawberry, Mango, Peach, Berry, Lemon, Grape, Coconut, Watermelon
Mint types: Mint, Menthol, Peppermint, Spearmint
Nuts & Grains: Almond, Hazelnut, Oat, Peanut
Sweet types: Chocolate, Caramel, Vanilla, Honey, Custard

Prohibited: Descriptive, playful, or misleading terms like “Ice Cream,” “Fresh Milk Tea,” or “Juicy Grape Burst.”


III. Prohibited Packaging Elements
Packaging and marketing must NOT:

  • Resemble food or cosmetics

  • Suggest lower harm compared to other products

  • Emphasize “natural,” “organic,” “healthy,” “energizing,” or “healing” attributes

  • Use misleading graphics, symbols, trademarks


IV. Point-of-Sale Display Rules
Retail stores may only display A4-sized notices with:

  • “Vaping products available here” (≤70pt font)

  • “No sales to persons under 18” (≥40pt font)

  • Black text on white background (printed or handwritten)

  • Max 1–3 notices allowed depending on store size

  • Poster-style displays strictly prohibited


V. What Retailers Can Communicate
Retailers and manufacturers are allowed to share:

  • Proper use and storage instructions

  • Effects and emergency actions for misuse

  • Health benefits of switching from smoking (e.g., “Switching completely to vaping reduces harm.”)

  • Ministry-approved multilingual translations available


VI. Required Safety Mechanisms
Each product must be backed by:

  • Consumer complaint tracking and resolution

  • Adverse reaction recording and reporting

  • Recall mechanism

  • Monitoring system for potential health concerns with nicotine/additives
